NOTICE IS HEREBY GIVEN that whenever the Borough of Cape May Point is required by law or by order or rule of any court to publish or advertise a legal notice, the Borough will publish the legal notice on the Borough’s official internet website, in compliance with P.L. 2025, c. 72. NOTICE OF PENDING ORDINANCE
07-2026 Calendar Year 2026 Ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish a Cap Bank (N.J.S.A. 40A:4-45.14)
In Summary, the purpose of this Ordinance is to allow additional spending in the next 2 years IF and only IF some currently unforeseen expense occurs. The NJ Municipal Budget Spending CAP is tied to the Cost of Living % increase. The statutes anticipate that there are circumstances where some expenses may increase by more than the COLA % and therefore allow additional spending up to a maximum of 3.5% if an Ordinance is adopted by the governing body. This Ordinance also allows unspent amounts from prior years to be banked for an additional 2 years. It is not the intention of the Borough Commission to increase spending.
The above ordinance was introduced on March 10, 2026 and will be taken up for second reading, public hearing and final passage at a meeting of the Cape May Point Board of Commissioners to be held virtually via Zoom on March 24, 2026, at 12:00 p.m. This Notice is posted in the Municipal Building and full copies may be obtained by the general public from the office of the Municipal Clerk or by clicking the title above.

PUBLIC NOTICE
Public notice is hereby given to all persons that the Borough of Cape May Point Planning Board has cancelled their regular meeting of Tuesday, March 17, 2026 at 6:30 pm. This notice is being given in compliance with the Open Public Meetings Act of 1975. The next scheduled meeting is Tuesday, April 21, 2026 at 6:30 PM at the Cape May Point Volunteer Fire Company and via Zoom. Access details are available on the Borough website and meeting agenda.

03-2026 An Ordinance Amending the Code of the Borough of Cape May Point, to Repeal and Replace Chapter 52, Affordable Housing
In summary, this ordinance replaces the Borough's existing regulations for the creation and administration of affordable housing in the Borough of Cape May Point with updated regulations for the Fourth Round that are consistent with the 2024 amended Fair Housing Act, 2025 rules from the New Jersey Department of Community Affairs ("DCA") and New Jersey Housing and Mortgage Finance Agency ("HMFA"), and the Borough's adopted Fourth Round Housing Element and Fair Share Plan.
04-2026 An Ordinance Amending the Code of the Borough of Cape May Point Chapter 150, Section 150-11 Permitted Uses
In summary, this ordinance amends the existing affordable accessory apartment standards in the R-1 Residential Zone of the Borough of Cape May Point to be consistent with the 2024 amended Fair Housing Act, 2025 rules from the New Jersey Department of Community Affairs ("DCA") and New Jersey Housing and Mortgage Finance Agency ("HMFA"), and the Borough's adopted Fourth Round Housing Element and Fair Share Plan.
05-2026 An Ordinance Amending Chapter 150 Zoning of the Code of the Borough of Cape May Point
In summary, this ordinance establishes new regulations for access ramps and temporary access ramps. The ordinance also requires first floors of asymmetric houses to consist of at least 40% of total square footage, and specifies that the area under the overhanging second floor does not count toward vegetative cover.
06-2026 An Ordinance Amending Section 35, Police Department, to Add Section 3, Procedures for Extra Duty Police Details
In summary, this ordinance establishes a procedure for public and private entities to pay established fees when they require extra duty police services.
